Please read these Terms of Service carefully before placing an order or using our website. By accessing esterromana.com or purchasing from us, you agree to be bound by these terms. These terms are governed by the laws of England and Wales.
1. About us
Ester Romana Limited is a luxury accessories company registered in England and Wales. Our registered address and company details are available on request. Contact us at info@esterromana.com.
2. Using our website
You may use this website for lawful personal purposes only. You must not use it in any way that is unlawful, harmful, or fraudulent, or that infringes the rights of others. We reserve the right to restrict or terminate access to anyone who violates these terms or misuses the site.
You are responsible for ensuring that any person who accesses our website through your internet connection is aware of these terms and complies with them.
3. Placing an order
When you place an order on esterromana.com, you are making an offer to purchase. A binding contract between you and Ester Romana Limited is formed only when we send you an order confirmation email. We reserve the right to decline any order at our discretion — for example, where an item is unavailable, where a pricing error has occurred, or where we are unable to verify payment.
For made-to-order and bespoke pieces, your order confirmation will include your agreed specifications (leather type, last, sole, customisation choices, and so on). Once you have confirmed these details and production has commenced, the order cannot be amended or cancelled.
You must be at least 18 years of age to place an order.
4. Pricing and payment
All prices displayed on this website are in pounds sterling (£) and are inclusive of UK VAT where applicable. For international orders, local taxes, import duties, and customs charges are not included in the displayed price and remain the customer’s responsibility.
We reserve the right to change our prices at any time. The price applicable to your order is the price displayed at the time you place it. In the event of a pricing error, we will contact you before processing your order.
Payment is required in full at the time of ordering. We accept major credit and debit cards and any other payment methods displayed at checkout. All transactions are processed securely by our payment providers.
5. Delivery
Delivery timelines are estimates only and are not guaranteed. We will make every effort to dispatch your order promptly, but we are not liable for delays caused by third-party couriers, customs processing, remote delivery locations, adverse weather, or other circumstances beyond our control.
Full details of our delivery options, timelines, and charges are set out on our Delivery & Returns page, which forms part of these terms.
6. Returns and cancellations
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel an order for standard (non-customised) items within 14 days of delivery without giving a reason. You must notify us in writing at info@esterromana.com within this period.
The following items are exempt from the right to cancel:
- Made-to-order shoes and accessories produced to your specification
- Bespoke or customised items where production has commenced
- Items reduced by 50% or more (final sale)
Full return conditions, timelines, and instructions are set out on our Delivery & Returns page.
7. Product descriptions
We take care to ensure that product descriptions, specifications, and images on this website are accurate. However, colours may appear differently depending on your screen settings and calibration. For made-to-order and bespoke items, the final product will be made to the agreed specification confirmed at the time of order, rather than matching photography on the website exactly.
We reserve the right to modify product specifications, discontinue products, or update pricing at any time without prior notice.
8. Intellectual property
All content on this website — including text, photography, product imagery, graphic design, the Ester Romana wordmark, the ER monogram, and the ER Crown emblem — is the intellectual property of Ester Romana Limited. Ester Romana and the ER Monogram are registered trademarks.
You may not reproduce, copy, distribute, modify, or use any content from this website for commercial purposes without our prior written consent. Unauthorised use of our intellectual property may result in legal action.
9. Limitation of liability
To the maximum extent permitted by applicable law, Ester Romana Limited shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of this website or our products, including but not limited to loss of revenue, loss of profits, or loss of data.
Our total liability in connection with any order shall not exceed the total amount you paid for that order.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
10. Privacy and data protection
We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, and protect your data are set out in our Privacy Policy, which forms part of these terms.
11. Website availability
We aim to keep esterromana.com available at all times, but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict access to the website for business or operational reasons without notice. We are not liable for any loss or inconvenience caused by the website being unavailable.
12. Third-party links
This website may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
13. Governing law and jurisdiction
These terms and conditions are governed by the laws of England and Wales. Any disputes arising out of or in connection with these terms or your use of this website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in Scotland, Northern Ireland, or another jurisdiction within the United Kingdom, you retain any statutory rights afforded to you under the laws of that jurisdiction.
14. Changes to these terms
We may update these terms from time to time to reflect changes in our business, legal requirements, or the services we offer. The date at the top of this page will reflect when the terms were last revised. Your continued use of this website after any changes are posted constitutes your acceptance of the updated terms.
